| Sole Agency
Terms and Conditions
A sole agency is where you have instructed Rightmove exclusively
to act as your agent. All negotiations for the sale of your
property shall be carried out through us.
Under a Sole Agent agreement you, the Owner, shall agree
to pay Rightmove a commission of 1.5% of the total Sales Price
including furniture and fittings (+VAT if applicable) if at
any time during the period of our sole agency the sale of
the property is completed to a purchaser:
(a) Introduced by Rightmove or with whom Rightmove had
negotiations about the property during that period; or
(b) Introduced by another agent or individual: or
(c) Who approached the Owner directly during that period.
A buyer we have introduced is anyone who has learned about
the property through our activity either directly or through
another person (for example - wife, husband, family member,
partner, business partner or as an appointee of the buyer).
It is possible for us to be the introducer even when there
is another agent instructed. Following termination of our
agreement, if you subsequently exchange contract, within 12
(twelve) months, with a buyer introduced by us, our fee will
be payable in full. For any breach of this agreement by the
Owner, the Owner will be liable to pay any lost sales commission
to the Sales Agent as a result of the breach.
In the event that Rightmove introduces a buyer who pays
a holding deposit, and subsequently does not proceed with
the sale, hence forfeiting the deposit, the Owner agrees to
pay to Rightmove a sales Commission equal to 15% of the
deposit received.
Term of Sole Agency Agreement
The sole agency agreement will last for an initial period
of 6 months from the date of commencement, and will continue
after the initial period, but may then be ended by either
party giving 14 days' notice in writing to the other. Notice
of termination cannot be given before the end of the initial
period.
Marketing Activity
Rightmove will actively market your property. This may
include advertising in local newspapers, billboards, office
displays, sales details, for sale boards, electronic advertising
including internet media, leaflets and other written or verbal
information given about the property.
We are able to more actively market your property under a
sole agency agreement than a multiple agency agreement.
